Liquidator Ducks Queries on Facilities Management Company for BCL Residential Houses Having commenced the process of disposing of BCL residential properties and first offering them to former and current copper mining company employees, BCL liquidator Darusha Moodliar has declined to discuss the current state of the houses and questions about the company tasked with managing them, Belservest Botswana. Belservest Botswana is an integrated facilities management company that is reported to have been taking care of the houses since 2019. [ihc-hide-content ihc_mb_type="show" ihc_mb_who="1,2,3,4" ihc_mb_template="1" ] Some of its directors are former Commander of the Botswana Defence Force (BDF) Lieutenant General Tebogo Carter Masire, the Chairman of the company Victor Senye, as well as Olebeng Ngwakwena. Current state In the wake of Moodliar’s announcement to sell the properties, The Business Weekly & Review sent a detailed inquiry to her about the current state of the houses and whether she is happy with how they have been taken care of. This newspaper wanted to establish when Belservest Botswana was appointed as the facility manager for BCL residential properties and the process leading to its appointment; specifically whether it was by direct appointment or tendering. If it was through tendering, the inquiry was interested to know how many companies responded and how many were shortlisted. Criteria Significantly, Moodliar was asked to state the other companies that made it to the top three if Belservest won in an open tender. If it was a direct appointment, what criteria were used to choose Belservest Botswana as the preferred company? The Business Weekly & Review also wanted to establish from the BCL Liquidator if the appointment of Belservest was to enhance the value of residential staff houses; and if so, how has the value increased? She was also asked to outline the scope of work for Belservest Botswana at the time of its appointment and whether these objectives have been met, in her view. Moreover, the BCL Liquidator was asked to state how much Belservest was being paid on a monthly basis. SA-based SANEK Trust In her response, Moodliar, director at South African-based SANEK Trust Recovery Services, stated: “Reference is made to the inquiry. I am the duly appointed liquidator of BCL Limited (In Liquidation) (“BCL”) and as such I am governed by the provisions of the Companies Act (Cap 42:02) and under the direct supervision of the Master and Chief Registrar of the High Court of Botswana.” She added that as a duly appointed liquidator, she has been mandated by the resolution of the general body of creditors to manage the affairs of the insolvent estate in the process of winding it up. “This authority includes the power to contract with service providers to assist with the process of winding up including the management of the estate assets,” she said. “My rights are reserved” “As stated, in the discharge of my duties, I am managed by the Chief Registrar and Master of the High Court.” She noted that all actions taken are in terms of the Companies Act, Court Orders, and resolutions of the general body of creditors. “Should you have any queries with respect to how I am discharging my obligations, you can refer them to the Chief Registrar who is copied,” she wrote. “My rights are reserved.” Senye, the Chairman of Belservest, has also declined to discuss his company’s dealings regarding BCL staff houses, citing contractual limitations. There are complaints however that the appointment of Senye’s company lacked transparency. Further, while the company was appointed partly to maintain the state of the properties to a certain standard, their current state is being questioned. [/ihc-hide-content]
